Travel Guru Destinations LLC (“Company,” “we,” “us,” or “our”) governs the website located at https://travelgurudestinations.com/ (the “Site”). These Website Terms & Conditions (“Terms”) govern your access to and use of the “Site”, including all content, functionality, forms, and services offered on or through the Site.
By accessing, browsing, submitting intake forms, or utilizing services on this Site, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Site.
1. AGENCY & SERVICE SCOPE
1.1 Independent Travel Advisory. Travel Guru Destinations LLC is a Texas Limited Liability Company providing custom travel research, itinerary design, group logistics, and booking services.
1.2 Engagement via Client Agreement. Utilizing our travel planning services requires acceptance of our separate Travel Planning & Professional Services Agreement, which is presented during onboarding/intake. In the event of a direct conflict between these Terms of Use and your signed/acknowledged Professional Services Agreement, the Professional Services Agreement shall control.
2. PRIVACY POLICY
By agreeing to these Terms of Use, you also agree to and acknowledge that you have read and understood our Privacy Policy, which is available at https://travelgurudestinations.com/privacy-policy/.
3. INTELLECTUAL PROPERTY & SITE USE
3.1 Ownership. All content, features, layout, design, text, logos, custom graphics, and software on this Site are the exclusive property of Travel Guru Destinations LLC or its licensors and are protected by United States and international copyright, trademark, and intellectual property laws.
3.2 Limited License. You are granted a limited, non-exclusive, non-transferable license to access the Site for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any content without prior written permission.
4. FEES, CANCELLATION & PAYMENT TERMS
4.1 Non-Refundable Planning Fees. All planning, research, and advisory fees paid to Travel Guru Destinations LLC are 100% non-refundable once paid.
4.2 10% Cancellation Fee. Once travel arrangements or services have been booked and confirmed on your behalf, a professional cancellation fee equal to 10% of the total cost of the canceled services will be assessed by Travel Guru Destinations LLC if you choose to cancel such services or the trip in its entirety.
4.3 Third-Party Charges. Our 10% cancellation fee is separate from, and in addition to, any non-refundable deposits, cancellation penalties, or fees assessed directly by third-party travel suppliers (e.g., hotels, airlines, tour operators, cruise lines). You remain fully responsible for all third-party supplier charges and penalties.
5. THIRD-PARTY SUPPLIERS & DISCLAIMERS
5.1 Independent Suppliers. All travel arrangements, accommodations, flights, tours, and transportation booked on your behalf are operated by independent third-party suppliers.
5.2 No Liability for Supplier Acts. Third-party suppliers are independent entities and not employees, agents, or partners of Travel Guru Destinations LLC. We assume no responsibility or liability for supplier defaults, flight cancellations, schedule changes, bankruptcies, delays, or failure to perform agreed services.
6. TRAVEL INSURANCE
6.1 Client Responsibility. Travel insurance is strongly recommended to protect your investment. It is your sole responsibility to request insurance details and purchase coverage. Travel insurance is not automatically included in any booking.
6.2 Waiver & Release. If you decline or fail to purchase travel insurance, you assume full financial responsibility for any unrecovered expenses, cancellation penalties, travel delays, medical emergencies, or lost baggage that could have been covered under a policy.
7. SITE DISCLAIMERS & LIMITATION OF LIABILITY
7.1 Accuracy & Pricing Errors. Information published on this Site or in travel proposals may contain inaccuracies or pricing errors. We do not guarantee the accuracy of, and disclaim all liability for, errors relating to hotel descriptions, pricing, photographs, amenities, or general product descriptions. We expressly reserve the right to correct any pricing errors on the Site and/or pending reservations made under an incorrect price.
7.2 Consequential Damages Waiver. IN NO EVENT SHALL TRAVEL GURU DESTINATIONS LLC, ITS MANAGING MEMBERS, OFFICERS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THIS SITE OR OUR SERVICES.
7.3 Booking Errors & Liability Cap. In the event of a booking error attributable to Travel Guru Destinations LLC (including, but not limited to, a ticket or reservation made for the wrong date, time, or destination), our sole and maximum financial liability shall be strictly limited to paying or reimbursing the direct, out-of-pocket cost necessary to correct or replace the affected ticket or reservation. Under no circumstances shall any error entitle you to a refund of the professional planning fee.
7.4 Risks & Assumption. Participation in travel activities involves inherent risks of accidents, personal injury, property loss, or damage. By engaging our services, you voluntarily assume all known and unknown risks associated with travel.
8. GOVERNING LAW & JURISDICTION
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any legal action or proceeding arising under or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Travis County, Texas.
